369-26 Public Comment In support of CCP 369 & 335 Two comments 369 & 335 Comments on 369-26 and 335-26 Final Paper 369-26 Flock Safety Presentation

Councillor Colon Hayes introduced this paper, offering a little background on how it came to become a necessary topic of discussion. Concerns revolving around the Flock camera system include security & privacy, access to videos, and record keeping timelines. She stated there is no further action needed on this paper right now but with it's passage, invitations will go out to all involved parties to come before the Council to present further information for the public on various aspects of the Flock cameras. It was agreed the presentation will be held during a committee of the whole meeting at a date yet to be established. The meeting will be held in Council Chambers, open to the public, and televised on UMA local access TV.

Councillor McDonald informed the body that the MPD Community Advisory Council conducted a public meeting in response to these concerns in February. Two documents that came out of that meeting are the Malden PD Flock Cameras FAQ Sheet and Malden PD Flock Agency Sharing List. Councillor McDonald asked the City Clerk to attach both to the history of this paper for public viewing.

A motion was made by Councillor O'Malley, seconded by Councillor Colon Hayes, that the Resolution be passed. The motion carried by a unanimous vote.

Presentation for Council 263-26 Retail Residential Kitchens

263-26 cottage bakery comment

263-26 City council Meeting letter

The State of Massachusetts has created rules and regulations for small business owners to produce shelf stable food goods from their home kitchens. An opportunity such as is presented in Paper 263-26 lowers the barrier to entry for entrepreneurship. Several neighboring communities have already successfully instituted cottage kitchens for their constituents. It is the hope of Councillor Luong, the paper sponsor, that bringing this program to Malden will encourage small business growth in the community.

OSPCD is recommending this paper be amended to reflect an effective date of January 1, 2027 to allow the Board of Health to establish the regulations necessary for inspections and oversight. Waste disposal and pest control regulations also must be reviewed to accommodate for the increased output generated from home kitchens. The Planning Board recommends approval with three conditions that the program begins as a pilot program, Board of Health regulations are in place, and no residential pick ups from customers are allowed.

Councillor Winslow expressed a desire to table this paper until certain areas of concern may be addressed. Most specifically, staffing is an issue. Inspectional Services currently has one inspector who must perform 500 inspections annually. Passing this paper will increase that burden without the benefit of any additional resources being directed to the department level. Councillor Winslow would like to see the Board of Health take this paper up at their September meeting, and obtain buy-in from the Building Commissioner prior to enrolling. His motion to table failed for lack of a second.

A motion was made by Councillor McDonald, seconded by Councillor Simonelli, that the Ordinance be amended to take effect on January 1, 2027. The motion carried by a unanimous vote.

A motion was made by Councillor Luong, seconded by Councillor Taylor, that the Ordinance be enrolled as amended. The motion carried by the following vote:

  • Presentation for Council 325-26 Pre-Existing Nonconformity
  • Allowance

One part of a larger economic development package, this paper was brought forward to allow for pre-existing non-conformities to expand by special permit. Current ordinance does not allow a path for growth to a successful business if they are in the PE/NC category. Rather than risk having the business move out of town, these amendments allow for a PE/NC to seek allowances via the special permit process.

Councillor Winslow expressed concern of just how much room for expansion an ordinance like this may allow for such businesses as storage unit facilities. He seeks to have this paper go back to Rules and Ordinance for further review of the planning process. The goal being to create guardrails to allow for sensible expansion balanced with comprehensive plan development.

After Zach's presentation, it was noted that exact wording on one of his slides was not the same as what was written in the final Council paper that was sent to Planning Board. To avoid any further confusion on wording, and in light of Councillor Winslow's concerns, the Council agreed it was best to refer back to committee for further review.

A motion was made by Councillor Winslow, seconded by Councillor O'Malley, that the Ordinance be referred to the Rules & Ordinance Committee. The motion carried by a unanimous vote.

Comment 327-26 Towing_Highway_Business_Request

One part of a larger economic development package, this paper was brought forward to allow for more uses by right as the special permit process is a deterrent to businesses seeking space in the city. If certain business uses make sense in certain industrial zones they should be allowed by right or by site plan review. The goal is to make it easier to fill vacant storefronts and building spaces.

The Planning Board recommended disapproval on some parts of the paper mainly around restaurants. They further recommended the creation of a Site Plan Review Committee for motels-hotels, supermarkets, restaurants-fast food and restaurants-all other. This paper would have to go back to committee to create the committee that will oversee PB recommendations. Councillor Winslow asked that once the paper is ready to be taken up in committee, language would be provided that makes clear for the Council all amendments necessary, acknowledging that the paper may have to go back for another public hearing if substantial changes are made.

A motion was made by Councillor Winslow, seconded by Councillor Colon Hayes, that the Ordinance be referred to the Rules & Ordinance Committee. The motion carried by a unanimous vote.

IZ Feasibility Study by RKG FINAL 335-26

IZ presentation for CC 335-26

Recom. Amendments 335-26 on Sept 15 2026

This paper, being the most intricate of the evening, was taken out of order by Council President Linehan to be discussed first. Director Pratt of OSPCD presented to the Council. His slides and the feasibility report referred to in his presentation are attached to the history of this paper.

Inclusionary Zoning is a policy that states market rate housing projects need to include a certain percentage of affordable units and provide incentives to offset the cost of the affordability requirements. These policies must be reviewed overtime to make sure the right balance between the two is maintained. Malden first adopted IZ in 2021 and was based on an economic feasibility analysis that was completed at that time. The affordability threshold was set at 15% of units in buildings over eight were required to be deemed affordable.

An updated study was completed this spring. The findings are that the current IZ policy is out of date and significantly prevents new housing from being built. Major changes that are being proposed at this time are changing the threshold from 15 to 10% of affordable units, changing the affordability threshold from 50% AMI to 60% AMI on the rentals, parking and density bonuses have been adjusted, with lower parking space mandates.

After spirited debate with several differing points of view from members of the body, it was decided this paper should go back into committee for a detailed discussion.

A motion was made by Councillor O'Malley, seconded by Councillor Sica, that the Ordinance be referred to the Rules & Ordinance Committee. The motion carried by a unanimous vote.
